Terms & Conditions

These Terms & Conditions apply to website services supplied by Tom Taylor trading as Clearpath Digital.

Clearpath Digital currently provides services to businesses and self-employed professionals for business purposes only.

Clearpath Digital is not VAT registered. No VAT is charged.

 

1. Quotes and project scope

Before a project starts, Clearpath Digital will agree the service, price and scope of work with the client in writing.

The agreed proposal, quote or written scope forms part of the agreement between Clearpath Digital and the client.

Work outside the agreed scope is not automatically included and may require a separate quote or written change to the project.

 

2. Current services

Clearpath Digital currently offers:

Proof-Building Website — £499

A tightly scoped website of up to three pages, with one combined revision round. Availability is limited.

Local Enquiry Website — £799

A website of up to five core pages, with two combined revision rounds. Exact pages and functionality are agreed before work starts.

Website Refresh Sprint — £399

Improvements to up to five existing pages on the client's current website platform, with one combined revision round.

The Refresh Sprint does not include re-platforming, major new functionality, significant new pages, major copywriting or a complete rebuild unless separately agreed.

Additional or different work may be quoted separately.

 

3. Payment

Unless otherwise agreed in writing:

  • 50% of the agreed project price is payable upfront to reserve the project and begin work;

  • the remaining 50% is payable before the completed website is launched, transferred or finally handed over.

Work does not begin until the required initial payment has cleared.

Clearpath Digital may withhold launch, transfer or final handover until all amounts due for the agreed work have been paid.

 

4. When work begins

A payment alone does not necessarily make a project ready to begin.

Before substantive work starts, Clearpath Digital may require the agreed brief, content, images, branding, access details and other information reasonably necessary to complete the project.

The client is responsible for ensuring that information, claims, images, logos and other materials they supply are accurate and that they have the necessary rights or permission to use them.

Clients should not send passwords, payment-card information or unnecessary sensitive information through the website enquiry form.

 

5. Timescales and client delays

Any estimated completion period begins only once the project is ready to proceed and the required information, access and initial payment have been received.

Clients should provide requested content, information, approvals and feedback within 5 working days, unless another period has been agreed.

If required information or feedback is not provided within that period, Clearpath Digital may pause the project and move scheduled work to another available date.

If the client does not respond for 30 days, Clearpath Digital may archive the project.

Restarting an archived project is subject to current availability and may require a revised schedule or quote where additional work or rework is necessary.

 

6. Revisions

The number of included revision rounds depends on the service purchased.

Feedback should be provided as one consolidated set of comments for each revision round.

Requests that introduce additional pages, functionality, substantial new content, redesign work or other work outside the agreed scope may be:

  • exchanged for other agreed work within the existing scope;

  • quoted separately; or

  • declined.

Additional work will not be treated as included merely because it was discussed in a message, call or meeting.

 

7. Third-party services and costs

Unless specifically included in the written proposal, the project price does not include third-party costs such as:

  • website-platform subscriptions;

  • domain names;

  • premium apps or plugins;

  • paid photography or stock assets;

  • specialist integrations;

  • advertising;

  • ongoing SEO services;

  • other third-party services.

The client is responsible for approved third-party costs applicable to their project.

 

8. Cancellation by the client

The initial 50% payment reserves project capacity and allows Clearpath Digital to begin preparation and work.

If the client cancels, Clearpath Digital may retain from the initial payment an amount reasonably reflecting:

  • work already completed;

  • project preparation already carried out;

  • time or capacity already committed to the project; and

  • non-recoverable costs reasonably incurred for the project.

This may amount to the full initial payment where the work and commitments reasonably justify it.

Where part of the initial payment has not reasonably been earned or committed, the remaining amount will be refunded.

 

9. Cancellation by Clearpath Digital

Clearpath Digital may decline or stop work where, for example:

  • the client requests unlawful, misleading or false content;

  • required information or access cannot be provided;

  • payment is not made when required;

  • the client repeatedly requests substantial work outside the agreed scope;

  • the project is materially different from what was originally agreed; or

  • continuing the work is otherwise unreasonable or impractical.

Where Clearpath Digital cancels without fault by the client, amounts paid for work that has not been completed or reasonably committed will be refunded as appropriate.

 

10. Results and marketing outcomes

Clearpath Digital provides website design and related services but does not guarantee particular search-engine rankings, enquiries, leads, sales, revenue or other commercial results.

Any discussion of improving clarity, trust, usability or enquiry journeys describes the purpose of the work and is not a guarantee of business performance.

 

11. Portfolio and testimonials

Clearpath Digital will not treat completion of a project as automatic permission to publish a case study, testimonial or commercial result.

Any testimonial, case-study claim or client-specific result used publicly will require appropriate factual support and permission.

 

12. Changes to these Terms

Clearpath Digital may update these Terms for future work.

The terms applying to an existing project are those agreed when that project was accepted, unless Clearpath Digital and the client agree otherwise in writing.
